MISTREATMENT WITH UPROOTED JOURNALISTS IN J&K

No law is beyond the humanity but what treatment has been adopted by the government of India and Jammu and Kashmir under the effigy of DIPR Jammu and Kashmir is very shameful and disgraceful act at the global level

World Press Freedom Day is celebrated every year on May 3rd around the world. The United Nations General Assembly declared May 3rd as World Press Day or World Press Freedom Day to raise awareness about the importance of press freedom and to remind governments to uphold and respect the right to freedom of expression. Democracy is built on the rights of the media, which plays a crucial role in redefining values. Therefore, our government should help protect journalists.

But this is not the case in our Indian state of Jammu and Kashmir. Here, might is right. What is happening to journalists here is shameful. The greatest tragedy is that despite repeated complaints, no action has been taken.

Previously, awards were given to journalists for good journalism, but now, journalists are being persecuted for doing good work and performing well; they are even being forced to go underground.

If you listen to the story of a journalist who has been rendered homeless and uprooted from their home, you will not only be horrified, but you too will shed tears of shame and sorrow at this deplorable situation.

The story of this journalist, rendered homeless and uprooted, is deeply regrettable and shameful. After completing his postgraduate studies in journalism, the Department of Information and Public Relations, Jammu and Kashmir, initially issued a No Objection Certificate (NOC) allowing him to continue his profession in publishing. However, based on regional discrimination, he was mentally tortured and unlawfully harassed with one excuse after another, forcing him to shut down his business. He was even compelled to go into hiding.

You know that after the unfortunate exodus the displaced and uprooted journalist has been forced to live a very miserable life and has been restrained from his freedom of expression though is guaranteed to him under the chapter of Indian constitution. The act of injustice for him is entirely the major setback in the literary industry and a case of injustice against him needs for an earlier consideration.

It is regrettable to say here that despite the journalist having filed numerous grievances online, no action has been taken in his favor. There is extensive evidence of collusion recorded here. What is happening to journalists because of these corrupt officials is not only a painful story, but also quite terrifying.

The situation in which the uprooted journalist has been incorporated is a matter of grave concern. The Ashok Kumar Raina Editor of daily Northern Times has been forced to move the world level unions for seeking interference for justice against the violation of all the fundamental rights of the uprooted and displaced citizen cum journalist.

As per the article 19(1)(a) the editor has constitutionally fundamental rights to do his job related to the profession of Journalism but it is unfortunate to say that how the DIPR Jammu and Kashmir forced him to leave his profession is a matter of grave concern. A great conspiracy has been hatched against him for the unknown reasons known by the administrative block of the state administration.

That needful and deserving Journalist is also restrained to do any other business in his own state for his right to livelihood.

That needful and deserve uprooted Journalist has been deprived from the loan facilities to do his job very well and smoothly.

The deserve and needful job aspirant Journalist has been deprived from getting job opportunities in his own state and country despite having qualified several competitive examinations on all India basis with a good record of merit.

Despite his repeated pleas for justice, no one in the administration block is willing to listen to him or address his grievances. The displaced journalist has been illegally and arbitrarily deprived of his freedom of expression and forced to abandon his profession through a series of pretexts. It is deeply concerning that the displaced journalist has been illegally harassed and mentally tortured, causing him significant financial loss and damage to his reputation in the market, and that deliberate delaying tactics have been employed against him.

That after the PG in mass communication the DIPR of information and Public Relations Jammu and Kashmir have permitted the uprooted and displaced journalist to carry on his periodicals under self-employment scheme and in this regard the DIPR Jammu and Kashmir have already issued the NOC in favor of the editor of daily Northern Times.

That after the big investment from the part of the editor to carry on his periodicals the DIPR Jammu and Kashmir thereafter betrayed and deceived the journalist and forced him to leave his profession one pretext to another unlawfully. That despite orders passed by the Honorable courts and time to time by the higher authorities the DIPR Jammu and Kashmir have all the times dishonored and have given very set back to the publisher.

That the editor of daily Northern Times also approaches before his/her excellency the president of India and despite the orders also passed from there in favor of the publisher but it is shock and dismay the DIPR remained the salient spectator and all the earning and career opportunity get loss to the victim uprooted journalist.

That the orders once were passed from the office of CM civil secretariat for grant of compensation to the victim publisher for thus he be able to carry on his profession smoothly but it is shock and dismay to say that the DIPR Jammu and Kashmir have not taken into consideration all the orders though were being passed in favor of him time to time.

That it is evident from the records of DIPR Jammu and Kashmir the lesser competent periodicals other the publisher of daily northern Times has been encouraged and promoted for the unknown reasons known by the answerable officials

That after unfortunate exodus the displaced journalist have made all efforts to get the job opportunities in his own country and in this regard, he has qualified several competitive examinations on all India basis but due to highest corruption practice within the all central departments and recruitment agencies the appointments were made of all those candidates all the times who never participated with him in any selection process.

That aftermath the Indian born citizen and journalist had made several complaints, grievances before the higher authorities concerned but neither the appointed candidates were being terminated nor the letter of appointment had been issued in favor of the uprooted and displaced citizen.

That after the completion of sound education that by born Indian citizen and displaced journalist is though entitle for his all fundamental rights to do exercise for his own business in his own state to get the job opportunities at par with other citizens of India but what under the circumstances in the secular India the government machinery fails to allow him to do his own business or to provide him the job opportunities in his own country.

It is very astonishing to say here that the government of Jammu and Kashmir also ignores to provide the loan facilities in favor of the displaced journalist to revive his profession or to do his any business to earn his livelihood in his own country.

The government of Jammu and Kashmir and Government of India fails to made the implementation of article 14,15,16,17,18,19(1)(a), article 21 in favor of the displaced and uprooted journalist and fails to implement the directions of higher authorities and honorable courts within the prescribed time causes him great loss not only on economic front but also on the reputation and career front also.

That the matter is absolutely abuses of human rights violation and during the period of his unfortunate exodus and the period of litigation the situation of the displaced journalist needs to addressed on the priority basis without any further delay

The displaced journalist has lost his home, ancestor’s property and is highly victim of the acknowledgement of the step motherly treatment and discriminatory act of the answerable administration blocks.

The homeless and devastated journalist also appeals to the entire media fraternity to come forward and provide all possible help in regard to implementation of all his fundamental rights guaranteed to him under the constitution of India.
